MARKETING SERVICES AGREEMENT BETWEEN QUALBE MARKETING GROUP, LLC (QUALBE) AND THE CLIENT (CLIENT)

The purpose of this Marketing Services Agreement (the ‘Agreement’) is to formalize the terms between Qualbe and Client.

1. Services Provided

Qualbe will provide the services described on page one of this Agreement. Client will have access to email and phone support. Upon cancellation of this agreement (either by Qualbe, Client request or failure of payment), websites developed by Qualbe will be taken down. The website domain will continue to be in the Client’s control. Any content owned by Qualbe will remain with Qualbe.

2. Obligation of Client

Client agrees to respond to Qualbe in a timely manner by either phone or email. Client accepts legal responsibility for all content provided to Qualbe including but not limited to content, photos and logos. Qualbe does not accept responsibility for content provided by the Client.

3. Reservation of Right

Qualbe works with companies that produce family-friendly content and reserves the right to immediately suspend or cancel the Client’s contract if the Client participates in illegal, fraudulent, misleading, offensive or deceptive business practices. This right extends to the right to edit, remove or change content on websites in order to comply with any applicable law or regulation or to protect Qualbe and/or the Client from potential liabilities or claims or any content or material Qualbe determines as offensive (including, but not limited to foul language, pornography, any sexually provocative content or derogatory remarks). This contract does not include an offer from Qualbe to be exclusive to the Client and the Client’s industry, location or target market.

4. Termination of Service

Client has the right to terminate this Agreement by providing 30-day written notice to Qualbe.

5. Governing Law

This Agreement shall be governed by the law of the State of Texas. In the event of a dispute, jurisdiction shall be in the State Courts of Texas and venue will be in Tarrant County, Texas.

6. Complete Agreement

This Agreement sets forth the entire understanding and agreement of the Parties with respect to its subject matter and supersedes all prior oral or written agreements, understandings and communications with respect to such subject matter.

Information We Collect

In order to serve our customers better and provide the best experience possible to our visitors, we collect certain kinds of information. Below are the basic kinds of information we collect.

Information You Volunteer:

We collect and store any information you provide to us through our websites, email or any other method. For example, you might provide basic information such as name, address, phone number and email address when searching our websites or requesting further information. At other times, we may collect responses to opt-in surveys and questionnaires. We use this information to provide you the services, products or information you request and to improve our websites and internal processes. You may choose not to provide any of this information; however, you understand that doing so may prevent access to products and services or the use of certain features of our websites.

Information Collected Automatically:

We collect some non-personally-identifying information whenever you use our websites. This includes the use of cookies to collect anonymous site usage statistics. For example, we automatically detect information about browsers and operating systems, as well as how visitors use our website. We may also collect anonymous statistics about interaction with marketing emails. We use this information to understand customer response to marketing efforts and to improve our websites and internal processes. We do not automatically collect any personal information and we do not store any personal information in cookies.

Analytics Tools:

We use analytics tools and other third party technologies, such as Google Analytics and DoubleClick Cookies, to collect non-personal information in the form of various usage and user metrics when you use our online Sites and/or Services. These tools and technologies collect and analyze certain types of information, including cookies, IP addresses, device and software identifiers, referring and exit URLs, onsite behavior and usage information, feature use metrics and statistics, usage and purchase history, MAC Address, mobile unique device ID, and other similar information.

The third party analytics companies who collect information on our Sites and/or Services and other online products and/or services may combine the information collected with other information they have independently collected from other websites and/or other online or mobile products and services relating to your activities across their network of websites as well as online and/or mobile products and services. Many of these companies collect and use information under their own privacy policies.

In addition to our use of technologies as described herein, we may permit certain third party companies to help us tailor advertising that we think may be of interest to you based on your use of TechSmith Sites and/or Services and to otherwise collect and use data about your use of TechSmith Sites and/or Services. You may opt out of the DoubleClick cookie by visiting the Google advertising opt-out page or you may opt out of Google Analytics by visiting the Google Analytics opt-out page.

Information Security

We take your privacy seriously and work to protect your information during transmission to us and after storage.

  • We use Secure Sockets Layer (SSL) to encrypt information sent during the ordering process.

We have implemented security policies, rules and technical measures for the personal data that we have under our control, in order to protect against:

  • unauthorized access
  • improper use or disclosure
  • unauthorized modification
  • unlawful destruction or accidental loss
  • All our employees and data processors, who have access to, and are associated with the processing of personal data, are obliged to respect the confidentiality of our visitors’ personal data.
  • We do not share your information with anyone outside our organization except those companies whose services you explicitly request through us.
  • We do not provide your information to any government body, except as required by law.

Third Party Advertising Technologies

In addition to using cookies and related technologies as described above, we also may permit certain third party companies to help us tailor advertising that we think may be of interest to users and to collect and use other data about user activities on our Sites and/or Services (e.g., to allow them to tailor ads on third party services). These companies may deliver ads that might also place cookies and otherwise track user behavior. These companies may use information about user behavior in order to provide customized advertisements across various services and products. In the course of providing these services, products or placing advertisements, these third party companies may place or recognize a unique cookie on your computer, and may record information to these cookies based upon your activities on any of our Sites and/or Services and on third party websites. Each of these companies uses this cookie information according to their own privacy and security policies. If you wish to not have this information used for the purpose of serving you targeted ads, you may opt-out as indicated in this Policy. Please note this does not opt you out of being delivered.

Children’s Privacy

We do not knowingly collect personal data from children. We do not sell products or services for purchase by children. Only adults, 18 and over, may purchase products and services from us. A parent or legal guardian providing a child’s personal information (including name and date of birth) to us implies consent for us to use that information for the purpose of providing the product or service being ordered and ONLY that purpose.
